New Legal Options Available to Online Sports Betting Takers

New Jersey became the first state to pass legalized sports betting in June of 2021. Soon after, the other major racetrack sportsbooks have come to the state, almost half an hours drive from New York City. There are now 16 online sports betting programs in the state (as well as soon to be 17) and unlike in Nevada, online clients can register online. Unlike Las Vegas, however, wagering on football and/or basketball games in New Jersey is against the law.

Although New Jersey's laws are similar to those found in other states concerning gambling, each jurisdiction has it own unique set of circumstances. As a result, there are some differences between the New Jersey gambling law and that of other gambling jurisdictions. For example, in New Jersey, lottery proceeds are exempt from income tax while in some jurisdictions gambling profits are taxable. Other differences include the minimum amount bet required by each wager and which card or numbers may be used for gambling purposes.

In June of 2021, Governor Chris Christie signed into law the Sports and Entertainment Protection Act. This Act prohibits the use of gambling proceeds from state or local government entities for the purpose of circumventing the provisions of NJPITA. Among other things, the act prohibits the State or the municipalities from granting licenses to gaming operators to host professional sports games. The Assembly voted in support of the bill, which was passed by the Senate earlier in the month. As a preemptive measure, the NJPITA also prohibits any casino operator from operating out of the State or from allowing non-residents to play in its licensed casino.

In August of 2021, the New Jersey Department of Gaming and Insurance issued a new regulation that takes effect in three months after the effective date of the new law. The Gaming and Business Regulations Act takes effect on January 1st of every year and Gaming and Business Regulations Act allows the State to revoke the license of any casino if it finds out that the operator has contravened any of its NJPITA provisions. If such violations are found, the casino may not renew its license. A refusal to renew the license may result in the cancellation of the casino's agreement with the State to operate the facility.
